General conditions
Article 1. Applicability
1.1 These general conditions apply to all offers, orders and agreements of ibizamode.nl.
1.2 By placing an order or accepting an offer, you agree to these terms and conditions.
1.3 Deviations from these terms and conditions may only be made in writing. All other provisions will then remain in full force and effect.
1.4 All rights and claims in these conditions also apply to intermediaries and other third parties engaged by ibizamode.nl.
Article 2. Offers & Agreements
2.1 All offers made by ibizamode.com are without obligation. We reserve the right to change prices, especially if required by law (see also Article 3.6).
2.2 A contract is only established after acceptance of Your order by ibizamode.nl. We reserve the right to refuse orders or impose additional conditions.
2.3 After ordering, the agreed price applies and cannot be adjusted in case of price reductions. However, you do have a statutory cooling-off period of 14 days to cancel your purchase without giving any reason.
Article 3. Prices & Payments
3.1 All prices are in euros, including VAT, but excluding shipping or other additional charges, unless otherwise stated.
3.2 Payment must be made in advance via the available payment methods: iDEAL, PayPal, Visa, Mastercard, Maestro, Sofort Banking.
3.3 In case of late payment, ibizamode.nl has the right to suspend or cancel the delivery.
3.4 In case of a price increase after ordering, you have 10 days to cancel your order.
3.5 Orders outside the EU: Please be aware of import duties. Outside the EU you do not pay 21% VAT, but import duties may apply to orders over €150.
Article 4. Delivery
4.1 The indicated delivery times are indicative and do not entitle to compensation if exceeded.
4.2 Delivery takes place when the products are ready for shipment.
Article 5. Retention of title
5.1 The products remain the property of ibizamode.nl until the full purchase price has been paid. However, the risk of the products already passes upon delivery.
Article 6. Intellectual Property
6.1 All intellectual property rights of the products remain the property of ibizamode.com or the original claimants.
6.2 ibizamode.nl does not guarantee that the delivered products do not infringe on intellectual property rights of third parties.
Article 7. Complaints & returns
7.1 Upon delivery, check that the products comply with the agreement. Report any discrepancies within 7 days of receipt via e-mail.
7.2 In case of a justified complaint ibizamode.nl can replace the product or refund the invoice value.
7.3 Returns without reason can be made within 14 days, provided the product and packaging are undamaged. Return costs are at your own expense. The return is at your own risk, ibizamode.nl is not liable for loss or damage during the return.
Article 8. Warranty
8.1 ibizamode.com provides warranty according to the terms and conditions of the manufacturer or supplier.
8.2 Complaints about visible defects must be reported in writing within 7 days of receipt.
Article 9. Orders & communication.
9.1 ibizamode.nl is not liable for miscommunication, delays or errors due to Internet use or other means of communication, unless there is intent or gross negligence.
Article 10. Force Majeure
10.1 In case of force majeure, ibizamode.nl may suspend delivery or dissolve the agreement, without being liable for compensation.
10.2 Force majeure includes all circumstances beyond our control that make the performance of the agreement impossible.
Article 11. Miscellaneous
11.1 Your provided address will be used for delivery unless otherwise notified.
11.2 Failure to directly enforce a provision does not mean that ibizamode.nl waives its rights.
11.3 If any provision is found to be invalid, the rest of the terms and conditions shall remain in full force and effect.
11.4 ibizamode.nl can engage third parties for the execution of orders.
Article 12. Discount codes
12.1 Discount codes are valid for a limited period and do not apply to previous orders or shipping costs.
12.2 If you return a product where a discount code has been used, the discount will be forfeited.
12.3 Discount codes are not redeemable for cash and may not be altered, falsified or used commercially.
12.4 Any fraud or attempted fraud will be recorded and will result in exclusion from further participation.
12.5 Discount codes cannot be combined with other discount offers.
Article 13. Applicable law & disputes.
13.1 All agreements and these terms and conditions are governed exclusively by Dutch law.
13.2 Disputes shall be submitted exclusively to the competent court in the Netherlands.
Article 14. Liability
14.1 ibizamode.nl is not liable for inaccuracies in product information provided by third parties.
